1. Agreement and eligibility

These Terms of Service and End User License Agreement (the "Terms") are a binding agreement between you and Internet Speed Test App (the "Company," "we," "us," or "our").

These Terms govern every mobile application, website, API, software product, and related service that we publish or operate and that links to these Terms, including Internet Speed Test App for iOS and Android (each an "App" and collectively the "Services"). App-specific terms shown in an App or store listing supplement these Terms and control if there is a direct conflict.

By downloading, accessing, purchasing, or using a Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you act for an organization, you represent that you are authorized to bind it.

You must be at least 13 and old enough to enter into this agreement where you live. Otherwise, a parent or legal guardian must review and accept these Terms and supervise your use.

2. The Services and feature-specific limitations

Our Apps may provide network testing and diagnostics, device utilities, automation, productivity, media, personalization, cloud, account, subscription, advertising-supported, or other functions described in their store listing or interface. Features may differ by App, platform, device, version, subscription level, and country.

For network Apps, the Services may measure throughput, latency, jitter, packet loss, DNS behavior, HTTP responsiveness, and host availability and may display IP, ISP, ASN, approximate location, history, comparisons, or diagnostics. Measurements are estimates, not certifications, and vary because of device capability, Wi-Fi, VPN use, congestion, routing, test servers, background activity, and distance.

3. License and ownership

Subject to these Terms, Internet Speed Test App grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app and access the Services for personal or authorized internal business purposes. This license does not transfer ownership.

The Services—including software, design, interface, graphics, text, compilation, branding, and the Internet Speed Test App name—are owned by or licensed to Internet Speed Test App and protected by applicable intellectual-property laws. Except where law permits despite this restriction, you may not copy, modify, distribute, sell, lease, sublicense, publicly display, create derivative works from, reverse engineer, decompile, or extract source code from the Services.

You retain rights in information you choose to submit. You grant us a limited, worldwide right to host, process, transmit, and display it only as needed to provide, secure, and support the Services and comply with law.

4. Authorization to test

You may use network and diagnostic tools only on devices, accounts, connections, networks, systems, domains, hosts, IP addresses, and ports that you own or are expressly authorized to test. The presence of a publicly reachable system does not itself constitute authorization.

You are solely responsible for obtaining permission and complying with organizational policies, provider agreements, acceptable-use rules, and laws applicable to a target. If you are unsure whether you have permission, do not run the test.

5. Acceptable use

You must not use or attempt to use the Services to:

  • access, scan, probe, monitor, disrupt, damage, or interfere with systems without authorization;
  • perform denial-of-service activity, credential attacks, exploitation, malware delivery, surveillance, harassment, or unlawful interception;
  • evade technical controls, rate limits, access restrictions, security protections, or usage limits;
  • submit malicious targets or content, impersonate another person, or misrepresent test results;
  • scrape, resell, mirror, or automate the Services at a volume inconsistent with normal interactive use without written permission;
  • use the Services in a way that infringes privacy, intellectual property, contractual, or other rights;
  • interfere with our infrastructure, test-server operators, providers, or other users; or
  • violate applicable law or facilitate another person's violation.

We may apply technical limits, block requests, or investigate apparent abuse. These measures do not create a duty to monitor every use.

6. Data usage, charges, and device impact

Speed tests intentionally download and upload data and can consume a substantial amount of bandwidth. Diagnostic tools also create network traffic. You are responsible for mobile carrier charges, roaming fees, ISP usage limits, overage charges, battery consumption, and effects on other users of the connection.

Use Wi-Fi or another appropriate connection if you have a limited data plan. Do not run tests where added traffic could impair safety-critical, operational, medical, industrial, emergency, or production systems. You are responsible for choosing when and where to test.

7. Third-party services, advertisements, and content

Apps may depend on or display services and content from app stores, cloud hosts, advertising networks, mediation platforms, analytics and attribution providers, crash-reporting tools, payment processors, notification providers, speed-test servers, DNS resolvers, IP-information providers, registries, and support services. These may include Google Play, Google AdMob, Firebase, Apple, AppLovin, Meta Audience Network, Cloudflare, and other providers identified in the App or our Privacy Policy.

Free or discounted Apps may display contextual or personalized advertising. Advertisers may control ad content and destination pages. You must not click ads fraudulently or interfere with ad delivery or measurement. We do not endorse third-party ads, offers, products, or content and are not responsible for third-party availability, accuracy, security, transactions, acts, or omissions.

Your use of third-party services is subject to their terms and privacy notices. Identification of a provider, server sponsor, ISP, organization, or registry does not imply endorsement.

8. App stores, paid features, and subscriptions

8.1 Purchases, trials, and renewal

Apps may offer one-time purchases, consumables, subscriptions, free trials, introductory offers, or paid feature levels. The applicable App Store, Google Play, or other authorized store displays the price, currency, billing period, trial, and renewal terms before purchase. Taxes may apply.

Subscriptions automatically renew unless you cancel through the store account before the deadline stated by that store. Your store account will be charged according to its rules. Deleting an App does not cancel a subscription. You may lose paid access at the end of the current billing period after cancellation. Except where law or store policy requires otherwise, partially used periods are not refundable.

A free trial converts to a paid subscription unless cancelled before it ends. We may change future prices or features as permitted by law and store rules, with required notice. Billing, cancellation, refunds, payment disputes, and payment credentials are handled by Apple, Google, or the applicable processor under its policies. We may receive order, entitlement, consumption, renewal, and refund status but not full payment-card information.

8.2 Apple-required acknowledgements

If you obtained an App through Apple's App Store, these Terms are between you and Internet Speed Test App, not Apple. Internet Speed Test App is responsible for the App and its content, maintenance and support, and addressing App-related claims, subject to applicable law. Apple has no maintenance or support obligation.

If an App fails to conform to an applicable warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, under its policies. To the maximum extent permitted by law, Apple has no other warranty obligation. Internet Speed Test App is responsible for product-liability, regulatory, consumer-protection, and intellectual-property claims to the extent required by law.

You represent that you are not located in a country subject to a US government embargo and are not listed on a US government prohibited or restricted party list. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.

8.3 Google Play

If you obtained an App through Google Play, Google is not a party to these Terms and is not responsible for the App or support except as required by Google Play terms. Purchases, subscriptions, cancellations, and refunds are also subject to the then-current Google Play terms and policies. In a conflict concerning store billing or distribution, mandatory Google Play rules apply.

9. Privacy, accounts, and feedback

Our Privacy Policy is incorporated into these Terms and explains how information is processed across our Apps, including advertising, analytics, purchases, permissions, and network tools. By activating a feature, you direct the Service to process the information and contact the providers needed to perform it.

If an App offers an account, you must provide accurate information, keep credentials confidential, and promptly notify us of unauthorized use. You are responsible for activity under your account to the extent permitted by law. We may reject, suspend, or reclaim usernames or accounts that violate these Terms, impersonate others, or threaten security.

If you provide ideas, suggestions, or feedback, you grant Internet Speed Test App a perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, and incorporate it for any lawful purpose without compensation. Do not submit confidential information or material you cannot lawfully provide.

10. Availability, updates, and changes

We may add, remove, limit, suspend, or modify features, endpoints, servers, benchmarks, compatibility, and access at any time. We do not guarantee that the Services, any specific server, or historical comparison will always be available. Maintenance, security events, provider changes, network failures, or legal requirements may interrupt access.

Updates may be required for continued use. We are not responsible when an unsupported device, operating system, network restriction, or failure to install an update prevents access. We may revise these Terms prospectively. Material changes will receive reasonable notice where practicable or legally required. Continued use after the effective date means you accept the revised Terms, except where law requires a different form of consent.

11. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and quiet enjoyment.

We do not warrant that results are accurate, complete, comparable, or suitable for your purpose; that defects will be corrected; that the Services will be uninterrupted or free from harmful components; or that a diagnostic result identifies every problem or vulnerability. Some jurisdictions do not allow certain disclaimers, so some of these provisions may not apply to you.

12. Limitation of liability and indemnity

To the maximum extent permitted by law, Internet Speed Test App and its licensors, providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, business, opportunity, goodwill, or data; service interruption; device or network damage; carrier charges; or losses caused by reliance on measurements or diagnostics, even if advised of the possibility.

To the maximum extent permitted by law, total aggregate liability arising from the Services or these Terms will not exceed the greater of (a) the amount you paid to Internet Speed Test App for the Services during the 12 months before the event giving rise to the claim or (b) US$50. This limitation applies across all theories of liability and does not limit liability that applicable law does not permit us to exclude or limit, including mandatory consumer rights.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Internet Speed Test App and its providers and representatives from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use, unauthorized testing, violation of these Terms, or infringement of another person's rights. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.

13. Suspension and termination

You may stop using the Services at any time. We may restrict, suspend, or terminate access when reasonably necessary to address a Terms violation, security risk, abusive traffic, legal requirement, provider restriction, or threat to users or infrastructure. Where appropriate, we may provide notice or an opportunity to correct the issue.

Upon termination, the license granted by these Terms ends. Provisions that by their nature should survive—including ownership, feedback rights, disclaimers, liability limits, indemnity, disputes, and general terms—will survive.

14. Disputes and general terms

14.1 Applicable law and courts

We do not designate a single governing jurisdiction in these Terms. Applicable law, mandatory consumer protections, and courts with jurisdiction will be determined under the conflict-of-law, consumer, and procedural rules that apply to the parties and dispute. Nothing in these Terms deprives you of non-waivable rights available where you live. These Terms do not require arbitration and do not waive participation in a class or representative action where permitted by law.

14.2 Informal resolution

Before filing a claim, you and Internet Speed Test App should attempt in good faith to resolve it by written notice describing the App, issue, and requested resolution. Send notices to contacts@speedtestmaster.net. This does not prevent urgent relief or use of a regulator, small-claims process, or other non-waivable right.

14.3 General provisions

These Terms, the Privacy Policy, applicable App-specific terms, and store disclosures are the entire agreement regarding the Services and replace prior understandings on that subject. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of Services, subject to applicable law.

Neither party is responsible for delay caused by events beyond reasonable control, except payment obligations. Headings are for convenience only. The English version controls to the extent permitted by law. No agency, partnership, joint venture, employment, or franchise relationship is created.
